This might be the last of several letters from Ezekiel to the New Brunswick Authorities requesting a land grant in the New Brunswick area:
"To his Excellency Thomas Carleton, Esq. Captain General and Governor in Chief of the Province of New Brunswick and Territories thereon depending Chancellor and Vice Admiral of the same, And to the Honorable Council Thereof,
The Petition of Ezekiel Cudney of Sheffield and in the County of Sunbury

Humbly Skeweth,
That your Petitioner unfortunate in his applications in regard to land and having a wife and four small children wishes to partake of the Royal Favour, there is a lot number thirty on the Qua Qou Lake formerly granted to one Carter who has been dead for two or three years. The lot now lying in a state of nature having no improvements thereon and destitute of neighbors being in a remote place...
Yet your Excellency's Petitioner hopes by prudent application to support his family thereon.
If your Excellency in Council sees cause to favour this Petition and give me a legal grant of the above mentioned premises. And your Petitioner as in duty bound would ever pray.

It is noted that in 1790 an Ezekiel Cudney is found in New York on the US Census, Did Ezekiel and clan move back to the US having been repeatedly denied a promised Land Grant in New Brunswick. In 1801 he appears in Niagara Twp, Lincoln, Upper Canada, (Ontario). His daughter Phoebe was born in Feb,1800, presumably in Niagara. Ferris b. 1796, claims he was born in the U.S. on the 1871 Census. This would indicate an arrival of the Cudney's in Ontario c 1796-1800.
