Matthew served in Captain Samuel Jordon Cabell's Co., 6th Va. Regiment of foot soldiers, U.S.A. (DAR records, Charline Hull 5/6/2003) Birth year of Matthew sons, John and Charles, obtained from the Tax Lists of Amherst County. Tax Lists compiled by N. Kiser. Some names of grandchildren from Charline Hull, descendant of Joseph Nelson Phillips (5/6/2003). It is the belief of many Phillips family researchers that Matthew Phillips is a brother of Zachariah Phillips (married Frances White). Two of the witnesses to Matthew's will - Leonard Phillips, Sr., and Leonard Phillips, Jr. - are probably Matthew's father and brother. Zachariah named one of his sons Leonard and he named a daughter Johannah. David Phillips was one of the witnesses to Matthew's will, and he and his wife Mary were appointed by Matthew to manage his property after his death. We believe this is the Mary Davis who is a sister to Mildred Davis who married Zachariah's son, Thomas. These men witnessed each others wills, deeds, and other legal documents during their lifetime. They purchased and received land patents on property adjoining or close to one another. A number of the Phillips family married back and forth into the Davis and Rucker families. Other names that keep coming up as a witness or as owning adjoining property are Harris, Purvis, and Roberts. The search for more information continues. Matthew Phillips died December 4, 1790. His nuncupative will was probated on January 18, 1791, in Amherst County, Virginia, and recorded in Will Book 3, Pages 177, 178, and 179. Transcription of Will: "In the name of God Amen, We Leonard Phillips Senr., Leonard Phillips, Junr., and Mary Phillips being pregnant and cald' upon as Witnesses by Matthew Phillips December 4 before his death To observe That These following Words to be his Last Will Which Runs as follows ---- "In the first place he desired that All his Just Debts To be paid of as quick as possible without selling of any The Estate if Possible to be Avoided. Secondly That his Wife should have a Maintenance Out of The Estate enduring her Widowhood; but if she Marys to have a Childs part. Thirdly for his Children when they Marry or Come of Age. To have an equal part of the Estate, And to Give his Children as good Education as the Estate will Afford. And Fourthly and Lastly he desired that David Phillips and his Wife Ann, Should be the Managers his estate after his Death if they Saw whearin they Could make any Advantage by Selling of the Land which now lives on, he was Willing that they should Dispose of it.
