Will of Benjamin Duncom (pp. 256-257)(Will Abstracts of Stafford Co., Va. 1729-1748)

In Name of God Amen I BENJA. DUNCOM of Saint Pauls Parish County Stafford Planter being sick but of perfect sence make my Last will & Testament revoking any wills by me before made. First I give the land whereon I now live to my Friend RICHARD BERNARD in Trust to give unto JOHN PESTRIGE the natural Son of SARAH PESTRIGE and in case John die with heirs to remain to WM. PESTRIGE another Son of said Sarah & he should die without heirs or making legal disposition then to the child said Sarah now goes with in the same manner and Sarah Pestrige to have the use of the same as long as she lives single to maintain the said children. Item I give to my Nephew THOMAS DUNCOM the Gun that was his Fathers. Item I give the rest of my Estate in Trust to my Friend Richard Bernard to be equally divided between the said Sarah and her children that are now living and the one that she goes with and that the said chattels be kept together for the better maintenance of the children and I do also appoint Sarah Pestrige my Executrix under the direction of my Friend Richard Bernard 6th July 1753.

At Court held for Stafford County 14th August 1753 The Last Will & Testament of Benja. Duncom deced presented by Sarah Pestrige Executrix therein names . . proved . . ordered to be certified and at Court held for this County 11th Sept 1753 Sarah then Entering into Bond Certificate granted for obtaining Probate . .

I'm not sure if the above makes things clearer or just muddies the waters that much more!!
