Benjamin Davis Will

I, Benjamin Davis, being weak in body but of sound mind and memory. Though call to mind the mortality of my body and knowing it is appointed for all to die, I do therefore make this as my last will and testament in manner and form as follows. First of all I recommend my soul to God who gave it and body to be decently buried and all my just debts to be paid. 2nd I give and bequeath unto my beloved wife Polly Davis these Negroes. Viz, Mary, Sally and Jane, two beds and furniture, one china press one folding table, one sugar chest, eight chairs one big chest three head horses, two cows one carry all and gear one yoke oxen and wagon. 3rd I give and bequeath unto beloved daughter Sally Ann H. Davis two negroes viz, Tony and John, two beds and furniture one candle stand seven chairs one grey mare bridle and saddle called the Nancy Pigeon Filly. Now my wife and daughter has heretofore been dissatisfied to live on the place whereon I now live it is my wish and desire that my executor have the liberty at my wife and daughter’s request to sell my land and the proceeds thereof to be equally divided between Polly Davis and Sally Ann H. Davis. It is my wish and desire that all my property of every kind not herein before given away be left on the place for the benefit of my wife and daughter equally. I do hereby nominate Nathan D. Sandiford my soul executor to this my last will and testament. Signed sealed and acknowledged in the presence of on this 17th day of February 1851.
