Mary Brinegar not wife of Richard Jacks?

I would like to start a discussion on Mary Brinegar not being the wife of Richard Jacks of Surry Co. I find this stated as a fact in many Jacks genealogies but I would like to contest this.

The Bible of Richard Jacks Jr. states that his father Richard Jacks Sr of Surry, NC died
Nov 17, 1831 and that Mary Jacks died Jul 7, 1822.

Now I have notes of a Mrs. Leora Bishop referring to a court case in Rown Co, NC concerning the heirs of Mary Brinegar. Here is a quote from Mrs. Bishop's notes:

"Minutes of April 1830 court: Case of Jacob Brinegar and others vs. Feb. and Garland Chaffin #8. This is over land granted Mary Brinegar in 1784 and which she and Richard Jackss conveyed to George Holbrooks in 1785 (who lived until Mar. 20, 1827). When Jacks married her he was not divorced from his other wife; he died Feb. 1822, and there was no privy examination of Mary who died Apr., 1821, so the heirs of said Mary by her former marriage claim the land."

As you can see the death dates for Richard and Mary do not agree with the death dates for the Richard and Mary in the Richard Jacks' Jr. Bible.

I suggest that the Mary who died July 7, 1822 was either Mary Sparks, the known first wife of Richard Jacks, or Mary Mullin Triplett who also married a Richard Jacks perhaps as his 2nd wife.

Martha
