Looking for additoinal information on the ancestors and family of John Mitchel b1792 in PA d~1862 PA. -Scott Ziolek ******************************** This document was transcribed from a photocopy of the handwritten petition by Scott Ziolek, 2006 ******************************** 612 May Term 1873 In the matter of the estate of To the Hon. the Juoges of the Orphans Court John Mitchel decd of the County of Snyder. The petition of Petition for Order of Sale John Mitchell and Henry B Pontius. Ex- ecution of the last Will & testament of John Mitchell, late of the Township of Limestone, County of Union & State of Penn, decd respectfully Referents: That the said John Mitchell, decd died on the third day of Aug. A.D. 1862: That on the 29th day of Dec A.D. 1858 the decedent made & published his last Will & Testament, and that the same was admitted to probate in the Register's Office at Lewisburg in the County of Union aformed on the 25th day of August A.D. 1862, and Recorded in Will Book ~~~ ~~~ pages ~~~ That in the said Will, among other things, it is thus contained, "Second - I will and dined that at my wifes death my land shall be sold if a fair price can be attained therefore, and the proceeds thereof equally divided among my children, together with the balance of my estate." - also - there after "I do hereby nominate my son John Mitchell and Henry B Pontius to be the Executors of this my last Will & Testament hereby revoking all former wills by me made." All of which appear more at large by reference to the exemplification of the said Will by the Register of the said county of Union hereto attached and made part of this petition. fair petitioner further represents that Sarah Mitchell, wife of the decedent, referred to in said Will, died Dec 8th 1872. That the following are the names and places of residence of of the children and heirs of the said John Mitchell decd Elizabeth inter- married with Elias Aurand residing in Penn Township, Snyder County, Pa, Daniel Mitchell, residing at Elkhart County Ind, Rebecca intermarried with Henry B. Pontius, residing at Kremer P.O. Snyder County, Pa. Sarah in- termarried George Pontius residing at Wilmot, Noble County, Ind. John Mitchell residing at New Berlin, Union Co. Pa. Mary intermarried with Tobias Wetzel, residing at Flemington, Clinton Co. Pa. Catherine, now deceased, intermarried with Charles Wolfe by whom she had two child- ren XXg: Amanda Wolfe & Catherine Wolfe, now living, residing at ~~~ ~~~ Noble County, Ind. Susannah, intermarried with Allen Mitchell, residing at New Berlin, Union County, Pa. Your petition further represents that the decedent died seized in his demesne as of fee of and in the fol- lowing described real estate, to wit: Tract No. 1. situate in Limestone, Township, Union Co. Pa. adjoining land of Samuel Schick on the East: Penns Creek on the South: Henry Seebold on the North and Philip Seebold on the West. containing fifteen acres, more or less. Tract No. 2. situate in Limestone, Township, Union Co. Pa. adjoining lands of Jacob Spangler, Samuel Schock, Abraham Schock, and Penns Creek - Containing twenty-one acres, more or less, with the appurtenances. Tract No. 3. situate in Jackson Township, Snyder Co. Pa. adjoining lands of Jacob Spangler, Henry Specht, George Weks And Tuscan Creek, containing Seven acres & thirty perches, more or less, being woodland Your petitioners therefore pray the Court to grant an Order directing and emploring them to sell the above described real estate situate in Jackson Township, Snyder County.
