The last will and testament of Dinah Whitehurst
In the name of God Amen
I Dinah Whitehurst of the County of Pitt and of the State of North Carolina being of sound and perfect mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following that is to say
First That my executor hereinafter named shall provide for my body a decent burial suitable to the wishes of my relations and friends and pay all funeral expenses together with my just debts howsoever and to whomsoever owing out of the money that may first come into his hands as a part or parcel of my estate. Item. I will that the balance of my property consisting of land and Negroes hereinafter named and all of my other property both personal and domestic be equally divided amongst my children and my grandchildren that are now living to their representation with exception hereinafter mentioned to wit. -
my land whereon I now live and all and every tract of land now belonging to me, and all of my Negroes namely Susan, Elizabeth, Hary Mahaly, Esther, Charity, Jom, Sarah, Orrange, Areny, Winsor, Peny and all of the increase of Negroes and Stock at my death, to be as aforesaid equally divided as follows. Namely My son Reuben Whitehurst to have one share to him and his heirs forever with this exception that is one note that I now hold against him amt. at this time to $48.44 to be paid over to the said Reuben as a part of his share.
Item. I will to my son William Whitehurst one equal share to him and his heirs forever.
Item. I will to son James Whitehurst one equal share to him and his heirs forever.
Item. I will to my son John Whitehurst one equal share to him and his heirs forever.
Item. I will to my daughter Elizabeth Barnhill one equal share to her and her heirs forever.
Item. I will that my daughter Dicy Hathaway shall have two notes that I now hold against Sampson Hathaway amt. at this time to thirty-three Dollars and thirty nine cts and five Dollars in money.
Item. I will that the children of Dicy Hathaway lawfully begotten of her body shall have one share in proportion to the foregoing items with this exception that is to be deducted out the amt. that I give to Dicy Hathaway to them and their heirs forever.
Item. I will that my Grandchild Jesse Barnhill share equal to the foregoing items to him and his heirs forever.
Item. I will that my Grandchildren Mary Jane Whitehurst and John H. Whitehurst shall have one share in proportion to the before mentioned items to them and their heirs forever.
Item. I will that my Grandchildren Bery A. House and James W. J. House shall have one share in proportion to the foregoing items to them and their heirs forever.
Item. I will that my Granddaughter M. J. Whitehurst shall have one third of my clothing.
And lastly I do hereby constitute and appoint my worthy sons William Whitehurst & John Whitehurst my lawful executors to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof herby revoking and declaring utterly void all other wills and testaments by me heretofore made. In witness whereof I the said Dinah Whitehurst do set my hand and seal this the 12th day of February A. D. 1847.
Signed sealed published and declared by the said Dinah Whitehurst to be her last will and testament in presence of us who at her request and in her presence do subscribe our names as witnesses thereto
