Smith State of Tennessee Bradley County I, Joseph Smith do hereby nominate and appoint John Smith my attorney in fact for me and in my name to divide and lay off for me my portion of land belonging to me in the State of Texas in harris and liberty Countys it being part of an undivided tract belonging to the estate of Christian Smith deceased and to do and transact all matters and things required to be done by me in my name so far as I am concerned as an heir in said estate as tho I was present and doing the same myself. Given under my hand and seal this the 8th day of May 1846. Joseph Smith seal, attest John McPherson S.C. Green. State of Tennessee Bradley County Personally appeared before me J.H. Robertson Clerk of the county Court for the County of Bradley aforesaid Joseph Smith the bargainer above named in the foregoing power of attorney, a man with whom I am personally well acquainted who acknowledges the execution of the same on the day it bears date for the purposes therein mentioned. Robertson whose name appears to the within certificate is the clerk of said County Court and that his certificate appears in due form of law. It is hereby certified that William Humherd Esqr. whose name appears to the above certificate is and was at the time of signing the same an acting Justice of the Peace in and for the County of Bradley in said state duly appointed commissr. & sworn and that full faith and credit should be given to all his official attestations as such. In testimony whereof I have hereunto set my hand and caused the Great seal of the State to be affixed at the city of Nashville on the 24th day of June 1846.
